Sobre el caso de Yair Klein

La Red Nacional de Iniciativas Ciudadanas por la Paz Contra la Guerra – REDEPAZ manifiesta su preocupación y extrañeza por el fallo del Tribunal Europeo de Derechos Humanos (TEDH) dentro del caso “Klein v. Rusia”, en el sentido de obstaculizar la extradición a Colombia del convicto de nacionalidad israelí Gal Yair Klein que en la segunda mitad de los años 80 entrenó a los grupos paramilitares, así como milicias del narcotráfico que tantas violaciones a los derechos humanos han cometido contra la población civil.

Desde el rechazo y condena enérgica al tipo de prácticas criminales que han conducido a violaciones de derechos humanos cometidos en el marco del conflicto armado colombiano, y en perspectiva de garantizar a las víctimas en Colombia la protección a sus derechos a la verdad, justicia y reparación, se reconoce que la decisión afecta el derecho a la justicia y el conocimiento de la verdad sobre la formación y operación de los grupos paramilitares en el país que es de vital importancia para la no repetición de estas estructuras criminales y su accionar.

La imposibilidad de que una persona que como Klein contribuyó desde su accionar a que miembros de grupos armados al margen de la ley cometieran toda práctica de violencia contra la población cumpla su respectiva sentencia en Colombia pone en juego los derechos de las víctimas y el proceso de justicia transicional por el que quiere transitar Colombia.

Con la amplia expectativa de que se apele la decisión se espera que el órgano que sea competente de revisión de la decisión permita el juzgamiento de esta persona en Colombia. En perspectiva del comunicado emitido por la Honorable Corte Constitucional en días pasados es importante que se reconozca que siendo Colombia un Estado Social de Derecho, que aboga por el cabal respeto de los derechos fundamentales, se cuentan con garantías para dar lugar a un juicio justo frente al caso en concreto, así como con la plena disposición para abogar por la protección del derecho a la justicia de tantas víctimas que en Colombia han sido objeto de las prácticas criminales de grupos armados al margen de la ley como han sido los grupos paramilitares.

The National Network of Citizen Initiatives for Peace Against War – REDEPAZ, expresses its concern and surprise for the ruling of the European Court of Human Rights (ECHR) in the case “Klein vs. Russia”, impeding the extradition to Colombia of the convicted Israeli citizen Gal Yair Klein, During the second half of the 1980’s decade, Mr. Gal Yair Klein trained paramilitary groups and drug trafficking militias that committed numerous human rights violations against civil society.

REDEPAZ strongly rejects and condemns the criminal practices that have led to human rights violations in the Colombian armed conflict. In addition, in the perspective of ensuring to the victims in Colombia the protection of their rights to truth, justice and reparation, REDEPAZ acknowledges that the ECHR’s ruling affects the knowledge of the truth about the formation and operation of paramilitary groups in the country. This information is of vital importance for the non recurrence of these criminal structures and their actions.

The impossibility that Mr. Klein - a person whose actions contributed to the commission of all sorts of violent practices by illegal armed groups against the civilian population - serves his sentence in Colombia, puts at stake the rights of the victims and the transitional justice process by which Colombia is transiting through.

REDEPAZ expects for a revision of the ruling, and hopes that the chamber competent of the review of the decision allows Mr. Klein’s extradition to Colombia to serve his sentence. In the perspective of the recent communiqué issued by the Honorable Constitutional Court of Colombia, it is important to recognize that Colombia is a State respectful of the Rule of Law, that advocates for the full respect of fundamental rights, as those in the investigation and trial. In the case in question, there are existing guarantees for a fair trial and for the respect of the convicted person’s rights in prison, as well as complete availability to advocate for the protection of the access to the right to justice for the large number of victims that have suffered from the criminal practices of illegal armed groups in Colombia, as the paramilitary groups have been.
